Terms of Service

1. About these terms
These Terms of Service ("Terms") govern your use of the WaxMark website at waxmark.co.uk (the "Site") and the products and services we provide (the "Service").
We are WaxMark ("WaxMark", "we", "us", "our"), a business based in the United Kingdom at 5 Stornoway Road, Castle Vale, Birmingham, West Midlands B35 6PA, United Kingdom.
By using the Site, creating an account, or placing an order, you confirm that you accept these Terms. If you do not accept them, please do not use the Service. You must be at least 18 years old to place an order.
2. What we provide
WaxMark lets you search for a vinyl record, design a custom sticker label for it (showing details such as artist, release title, track list, BPM, key and side markers), and order that label printed and posted to you. Each label is produced to your specification. We may update, change or withdraw features of the Service at any time, and will try to give reasonable notice of significant changes where we can.
3. Accounts
You can browse, search and design labels without an account. An account is required only to complete an order.
When you create an account you agree to provide accurate, current information (including a valid email and delivery address), keep your password confidential, not share your account, and take responsibility for activity under it.
We may suspend or close an account that breaches these Terms, that is used for fraudulent or unlawful activity, or where we are required to do so by law. You may close your account at any time by contacting us at hello@waxmark.co.uk.
4. Designing labels and your content
The label designer lets you enter and edit text and choose layouts and colours. You are responsible for the accuracy of everything you enter — artist names, track titles, BPM, key, catalogue numbers and any custom notes. Please check your design carefully before ordering, as labels are made to the specification you submit (see Section 8).
4.1 Your content
You keep ownership of the content you create or enter ("Your Content"). By submitting Your Content you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and print it for the purpose of fulfilling your order and operating the Service.
4.2 Your responsibilities and warranties
You confirm that you have the right to use the content you submit, and that Your Content does not infringe the intellectual property, trademark or other rights of any third party, and does not contain unlawful, defamatory, obscene or offensive material.
You agree to indemnify us against any claims, losses or costs arising from content you submit that breaches this section. We do not pre-vet the text on labels and are not responsible for verifying that you are entitled to reproduce a particular artist name, release title or track title.
4.3 Our right to refuse
We may refuse or cancel any order, and remove any content, that we reasonably believe breaches these Terms or applicable law. If we cancel a paid order for this reason, we will refund you.
5. Record data, BPM and key
Record search results are drawn from the Discogs monthly data export (used under its CC0 licence) and from records contributed by the WaxMark community. We do not guarantee that any record, track listing, BPM or key value is accurate or complete.
BPM and key values are sourced from your own audio detection or from community submissions, never from Discogs. Community-contributed values carry a confidence indicator, but they are provided "as is" and you should verify anything important before printing.
Discogs: This application uses Discogs data but is not affiliated with, sponsored or endorsed by Discogs.
6. Community contributions
If you submit a record, a BPM or key value, or a preview link to the community database, you grant us and other users a perpetual, non-exclusive, royalty-free licence to store, display and use that contribution within the Service. Community contributions are stored as aggregate data only and are not published against your identity. We may remove, hide or correct community contributions at our discretion, including links reported as broken.
6.1 Preview links
Preview links may point only to YouTube or SoundCloud. WaxMark does not host, store or stream any audio or video — a preview link is simply a pointer to content hosted on those third-party platforms, opened on their own sites.
When you submit a preview link you confirm that you have the right to share it and that, to the best of your knowledge, it does not link to material that infringes copyright. Linking to content that has been uploaded or shared without the rights holder's permission may be unlawful. This is brought to your attention when you submit a link, and by submitting one you accept responsibility for the link you provide. You agree to indemnify us against any claim arising from a link you have submitted.
6.2 Reporting copyright
Any user can flag a preview link using the "Report copyright" control shown alongside it. When a link is reported in this way it is removed immediately and automatically, without prior review, so that potentially infringing material is taken down promptly. We may also remove any link at our own discretion. If you are a rights holder and wish to report content, you can additionally contact us at hello@waxmark.co.uk; you should also use the reporting tools provided by YouTube or SoundCloud for content hosted on their platforms.
7. Orders, pricing and payment
7.1 Placing an order
A contract is formed when we confirm your order by email after successful payment. Until then, no contract exists and we may decline the order (for example, if there is a pricing error or we cannot fulfil it).
7.2 Minimum order and pricing
The minimum order is 10 labels. Pricing is tiered — the price per label decreases as quantity increases — and is shown on the Site before you pay. Postage is charged separately and selected at checkout. All prices are in pounds sterling (GBP) and include VAT where applicable. We may change prices at any time, but changes do not affect orders already confirmed.
7.3 Payment
Payment is processed by Stripe. We accept Visa, Mastercard and American Express, and may also offer Apple Pay and Google Pay. We do not receive or store your full card details. By paying, you agree to Stripe's terms as well as ours. If a payment fails or is reversed, we may cancel or hold the affected order.
7.4 Pricing errors
If we discover an error in the price of items you have ordered, we will contact you to confirm whether you wish to continue at the correct price or cancel for a full refund.
8. Custom products — cancellation and returns
Please read this section carefully.
Every WaxMark label is custom-made to your specification. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the standard 14-day right to cancel does not apply to goods that are made to your personal specification or clearly personalised.
This means that once your order is confirmed and enters production, you cannot cancel it or return it for a refund simply because you have changed your mind, including where you have made an error in your design.
Everything on your label is editable and is yours to check. Where a record is found in our catalogue, details from the Discogs database (such as artist, release title, catalogue number and track listing) are used only to pre-fill the designer. These fields are fully editable, and the label is printed exactly as you submit it. Please review and correct every field before purchase — including anything that was pre-filled — as we cannot refund or replace an order because of information you could have changed before ordering.
What you see in the preview is what we print. The on-screen preview shows exactly how your label will look when printed, including how longer text is sized or shortened to fit the template. Please check the readability and fit of your label in the preview before ordering — if it doesn't read the way you want, you can edit your text or switch template at no cost. If the printed label does not match the preview you approved, that is our error and is covered as a faulty or incorrect order under Section 9.
As a goodwill gesture, if a pre-filled detail taken from Discogs turns out to be clearly and verifiably incorrect — and not simply a matter of preference or a change you could have made yourself — we may, at our discretion, offer a replacement. We will check the Discogs entry against other reliable sources first. This is in addition to, and does not affect, your statutory rights for faulty goods under Section 9.
This does not affect your legal rights in relation to faulty goods (see Section 9).
9. Faulty, damaged or incorrect goods
Nothing in these Terms removes or limits your statutory rights under the Consumer Rights Act 2015. If your labels arrive faulty, damaged, or are not what you ordered because of an error on our part (for example a misprint that does not match your submitted design), please contact us at hello@waxmark.co.uk within 14 days of delivery with a description and, where possible, a photograph. Where the fault is ours, we will reprint and resend the affected labels, or provide a refund where you are entitled to one.
We are not responsible for errors that were present in the design you submitted and approved.
10. Production, dispatch and delivery
We aim to print and dispatch orders within 2–3 working days of payment confirmation. Delivery timescales after dispatch depend on the Royal Mail service you choose at checkout and are outside our control. Postage estimates are provided in good faith but are not guaranteed. All orders ship as a single package regardless of quantity. Risk in the goods passes to you on delivery.
If an order has not arrived within a reasonable period after the expected delivery window, contact us and we will help investigate, including using tracking where a tracked service was selected.
11. Intellectual property in the Service
The WaxMark name, logo, branding, Site design, templates and underlying software are owned by us or our licensors and are protected by intellectual property law. You may not copy, reproduce, scrape, reverse-engineer or create derivative works from the Service except as expressly permitted. Your licence is limited to using the Service for its intended purpose, including designing and ordering labels for your own use, whether personal or in the course of your DJ work.
12. Acceptable use
You agree not to use the Service for any unlawful or fraudulent purpose; attempt to gain unauthorised access to the Site, our systems or other users' data; scrape, harvest or bulk-extract data from the Site; introduce malicious code or interfere with the Service's operation; or submit content that is unlawful, infringing or abusive.
13. Availability and disclaimers
We try to keep the Site available and accurate but we do not guarantee uninterrupted access or that the Site will be free of errors. The Service, and record data within it, are provided "as is". To the extent permitted by law, we exclude implied warranties not expressly set out in these Terms.
14. Liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory rights as a consumer.
Subject to that, we are not liable for losses that were not foreseeable at the time the contract was formed, or for loss arising from inaccurate record data, BPM, key or community content. To the extent permitted by law, our total liability in connection with any order is limited to the amount you paid for that order.
15. Privacy
Our use of your personal data is governed by our Privacy Policy, available on the Site, which forms part of these Terms.
16. Changes to these terms
We may update these Terms from time to time. The version in force is the one published on the Site when you place an order. Material changes will be notified where reasonable.
17. Governing law and dispute resolution
These Terms are governed by the laws of England and Wales. We will always try to resolve any complaint with you directly first, so please contact us before taking any other step. Any dispute that cannot be resolved is subject to the exclusive jurisdiction of the courts of England and Wales, although if you live elsewhere in the UK you may bring proceedings in your home jurisdiction.
